1. Acceptance of Terms

By downloading, installing, or using the Kinnect : Family Sync mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is developed and operated by the developer of Kinnect ("we," "us," or "our").

2. Description of Service

Kinnect is a family wellness application that allows connected family members to share health activity summaries (steps, heart rate, calories, sleep, exercise), location information, and device status. The App provides smart alerts and notifications to help families stay informed about each other's well-being.

3. Account Registration

You must create an account to use the App. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Family Connections

The App allows you to invite and connect with family members. By connecting with another user, you consent to sharing your health summaries, location data, and device status with that user. You may disconnect from a family member at any time, which will stop data sharing between you and that user. You are responsible for managing your family connections and should only connect with people you trust.

5. Health Data

The App accesses health data from Apple HealthKit with your explicit permission. This data is used solely to provide health summaries within the App. The App is not a medical device and does not provide medical advice. The health information displayed is for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with any health concerns.

6. Location Services

The App uses location services to share your position with connected family members. You can enable or disable location sharing at any time through your device settings. Location tracking accuracy depends on your device and environmental conditions.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or to violate any laws
• Harass, stalk, or monitor individuals without their consent
• Attempt to gain unauthorized access to other users' accounts
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App in any way that could damage, disable, or impair the service
• Create multiple accounts for fraudulent purposes

8. Intellectual Property

The App and all associated content, features, and functionality (including but not limited to design, text, graphics, logos, and software) are the property of Surround Global LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER OF KINNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH OUTCOMES, OR PERSONAL INJURY ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE APP.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App and request account deletion at any time by contacting us. Upon termination, your right to use the App ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in California.
